Terms of Service

These Terms govern your use of simplephysique.com and the coaching services offered by Mike Giddings ("Simple Physique"). By using the website or buying a coaching package, you agree to these Terms. If you do not agree, do not use the service.

1. The service

Simple Physique provides 1:1 online fitness coaching: a custom training and nutrition protocol, weekly video check-ins, daily messaging access, and supporting written content. All coaching is delivered remotely.

2. Eligibility

You must be at least 18 years old and have no medical condition that makes exercise or dietary changes unsafe without medical supervision. If you have any pre-existing health condition, you must get clearance from a qualified medical professional before starting the protocol.

3. Health and medical disclaimer

Read this carefully.

Mike Giddings is not a medical doctor, registered dietitian, or licensed healthcare provider. The information and recommendations provided by Simple Physique are for general fitness and educational purposes only and do not constitute medical advice, diagnosis, or treatment.

You should consult a qualified healthcare professional before beginning any new exercise program or making significant changes to your diet. The protocol is not a substitute for medical care.

By using our services, you acknowledge that you are voluntarily participating in physical exercise and nutrition changes, that you assume all risks of injury or adverse health outcome, and that you will stop immediately and seek medical advice if you experience pain, dizziness, shortness of breath, or any unusual symptom. You will not hold Simple Physique or Mike Giddings liable for any health consequence arising from your participation.

4. Payment

Coaching is billed monthly via our payment processor. Subscribing authorizes recurring charges until you cancel. All packages have a three-month minimum term. To cancel, email mike@simplephysique.com at least seven days before your next billing date. Cancellation takes effect at the end of the current billing cycle. If payment fails for more than 14 days, your engagement is suspended.

5. The 30-day guarantee

If you attend all four weekly 15-minute check-in calls during your first 30 days as a client and do not see visible composition change at the end of those 30 days, we will continue working with you at no further cost until you do. The guarantee is offered in good faith and is limited to clients who attempt the protocol as prescribed. It is a service-continuation guarantee, not a money-back guarantee.

6. Your responsibilities

Provide accurate information about your weight, health history, and goals. Follow the protocol within your stated constraints. Communicate openly during check-ins. Do not redistribute, resell, or share the protocol or bonus materials with anyone outside your immediate household.

7. Intellectual property

All content provided by Simple Physique remains the intellectual property of Mike Giddings. You receive a personal, non-transferable license to use it for your own benefit during your engagement and afterward. You may not republish, resell, sublicense, or use the materials to coach others commercially.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect or consequential damages, or for any injury, illness, or health outcome arising from your participation. This does not exclude liability for fraud, gross negligence, or anything else that cannot be excluded under South African law.

9. Termination

We may suspend or terminate your engagement for unpaid invoices, material breach of these Terms, or abusive conduct. You may cancel at any time per Section 4.

10. Governing law

These Terms are governed by the laws of South Africa. Any dispute will be resolved in the courts of Cape Town, Western Cape, unless both parties agree to alternative dispute resolution.

11. Changes

We may update these Terms occasionally. Material changes will be emailed to active clients. The "last updated" date at the top of these Terms reflects the most recent revision.
